Peace Now Gets Too Cocky

State Attorney does about face – attacks Peace Now

Makor Rishon correspondents Yehuda Yifrach, Uriel Nizri and Yair Krauss report in the 19 October edition that in what might be considered an “about face”, the State Attorney's response to the Supreme Court on behalf of the State in a case filed by Peace Now for the demolition of six communities in Judea and Samaria, the response noted that:

#1. Peace Now filed on their own instead of on behalf of Palestinians claiming to own the land. “It is important that the claim be filed by the proper subjects of the case and not by a public claimant getting involved in a dispute that is not theirs,” the State argued. The State argued that the absence of the Palestinians in the case made it impossible for the court to arrive at the truth.

#2. Peace Now also filed the case against the Israeli authorities without including the Israelis residing in the communities as a respondent. The State argued that this was a defect in the filing as “there is great importance in bringing the existence of the claim to the attention of the relevant elements that could be hurt by the claim's acceptance.”

 #3. The Peace Now claims ignore that the status of communities is now being deliberated in the IDF Appeals Committee – a move that “raises the danger that the factual picture will be incomplete, with all the ramifications.”

#4. There is no logic in combining six communities in one case when “there are legal and factual differences of significance for the deliberations” between them.
